**TERMS OF SERVICE**

 **AGREEMENT BETWEEN USER AND RIGGS SUPPLY SOLUTIONS (RIGGSS.COM)**

 1. **Introduction**: This Terms of Service Agreement ("Agreement") is made between Riggs Supply Solutions ("Company", "we", or "our"), the owner and operator of Riggss.com, and any user of our website ("User", "you", or "your").

 **ARTICLE 1: TERMS OF SERVICE**

 1.1. **Acceptance**: By using our website, you acknowledge that you have read, understood, and agreed to be bound by this Agreement. If you do not agree with these Terms of Service, you must immediately stop using Riggss.com.

 1.2. **Changes to the Agreement**: We reserve the right to modify or update this Agreement at any time without prior notice. Your continued use of our website after changes are made constitutes acceptance of the new terms.

 **ARTICLE 2: SHIPPING POLICY**

 2.1. **Shipping Methods**: We ship products via various shipping carriers, including but not limited to USPS, UPS, and FedEx. Estimated delivery times are provided for each product and may vary based on your location and other factors.

 2.2. **Shipping Costs**: Shipping costs are calculated during the checkout process based on your location and the weight and size of the products you are ordering.

 2.3. **Delivery Timeframe**: We aim to ship all orders within 24-48 hours after receipt of payment. However, in some cases, shipping may take longer due to unforeseen circumstances or high-volume orders.

 2.4. **Tracking Information**: Tracking information will be provided for each shipment once it is processed and sent out.

 2.5. **Delivery Issues**: In the event that your package is lost, damaged, or delayed during transit, we recommend contacting the shipping carrier directly to resolve any issues.

 **ARTICLE 3: RETURN POLICY**

 3.1. **Manufacturer Warranty**: Products sold on Riggss.com are covered under their respective manufacturers' warranties. Any defective products must be returned within a reasonable timeframe and will be repaired or replaced according to the manufacturer's warranty terms.

 3.2. **Non-Defective Returns**: Non-defective returns are subject to a 10% restocking fee, which will be deducted from the refund amount. Refunds will only be issued for items in their original condition with all packaging, accessories, and tags intact.

 3.3. **Return Window**: You have 30 days from the date of delivery to initiate a return. Returns must be initiated within this timeframe or they may not be accepted.

 **ARTICLE 4: WAIVER OF LIABILITY FOR STOLEN OR DAMAGED PACKAGES

** 4.1. **Stolen Packages**: We are not responsible for packages that are stolen after delivery. It is your responsibility to ensure that you are present at the time of delivery or make arrangements with the shipping carrier for package pickup.

 4.2. **Damaged Packages**: We are not responsible for packages that are damaged during transit due to circumstances outside our control, such as weather conditions or mishandling by the shipping carrier.

 **ARTICLE 5: REFUND AND EXCHANGE POLICY**

 5.1. **Refunds**: Refunds will only be issued within 7-10 business days after delivery. Refund amounts will be based on the original purchase price minus any applicable restocking fees or shipping costs. Proof with photos of of this issue will be requested. 

 5.2. **Exchanges**: Exchanges are only allowed for identical products in new, unopened condition with all packaging, accessories, and tags intact. Exchanges must be initiated within 15 days of delivery and will be subject to a 10% restocking fee.

 **ARTICLE 6: PRODUCT INFORMATION AND DESCRIPTIONS

** 6.1. **Product Accuracy**: We strive to provide accurate product information and descriptions. However, in some cases, products may vary from their descriptions or images due to manufacturer changes or errors.

 **ARTICLE 7: COPYRIGHT AND INTELLECTUAL PROPERTY**

 7.1. **Copyright**: All content on Riggss.com, including but not limited to text, images, and graphics, is protected by copyright law. You are prohibited from copying, reproducing, modifying, or distributing any of our intellectual property without prior written consent.

 8.1. **Indemnification**: You agree to indemnify and hold Riggss.com and its affiliates harmless for any claims, damages, losses, or expenses arising from your use of our website, including but not limited to breach of this Agreement, copyright infringement, or other intellectual property violations.

 **ARTICLE 9: DISCLAIMER OF WARRANTIES**

 9.1. **Disclaimer**: We disclaim all warranties, express or implied, regarding the products sold on Riggss.com, including but not limited to their merchantability, fitness for a particular purpose, and non-infringement.

 **ARTICLE 10: LIMITATION OF LIABILITY**

 10.1. **Limitation**: Under no circumstances shall Riggss.com be liable for any damages or losses arising from your use of our website, including but not limited to direct, indirect, consequential, punitive, or special damages.

 **ARTICLE 11: GOVERNING LAW AND JURISDICTION**

 11.1. **Governing Law**: This Agreement shall be governed by and construed in accordance with the laws of the State of Wisconsin located in the United States Of America, without giving effect to any principles of conflicts of law that would result in the application of a different jurisdiction.

 **ARTICLE 12: ENTIRE AGREEMENT AND AMENDMENTS**

 12.1. **Entire Agreement**: This Agreement constitutes the entire agreement between you and Riggss.com regarding your use of our website, and supersedes all prior or contemporaneous agreements, whether written or oral.

 12.2. **Amendments**: We reserve the right to amend this Agreement at any time without prior notice. Your continued use of Riggss.com after changes are made constitutes acceptance of the new terms.

 **ARTICLE 13: TERMINATION**

 13.1. **Termination**: We reserve the right to terminate your account and access to our website at any time, with or without cause, and without prior notice.

 **ARTICLE 14: GENERAL PROVISIONS**

 14.1. **Waiver**: The failure of Riggss.com to enforce any provision of this Agreement shall not constitute a waiver of such provision.

 14.2. **Assignment**: We reserve the right to assign our rights and obligations under this Agreement, in whole or in part, without prior notice.

 14.3. **Entire Agreement**: This Agreement constitutes the entire agreement between you and Riggss.com regarding your use of our website, and supersedes all prior or contemporaneous agreements, whether written or oral.
